Privacy Statement - IMCD Mexico

1. Data controller.
The person responsible for collecting, processing or using the personal data (Personal Data: Any information concerning an identified or identifiable natural person) that you provide to us is IMCD México, S.A. de C.V. (hereinafter "IMCD").

2. Direct sources of collection of Personal Data.
We collect your Personal Data directly when you provide it to us in person, by telephone, by filling out a paper or digital form, by email, through our www.imcdgroup.com website, the website of any IMCD affiliate, or our MyIMCD client portal ("IMCD Websites").
Privacy Statement: All personal data provided to or collected through the IMCD Websites is ultimately controlled by IMCD N.V., a company registered in the Netherlands with information linked to you through the following sources: (i) communications of Personal Data from affiliated registration number 51470497, with registered office at Wilhelminaplein 32, 3072 DE Rotterdam, The Netherlands.

3. Indirect sources of collection of Personal Data.
In those cases in which IMCD has a legitimate basis, it may obtain companies (for the purposes of this Privacy Notice, affiliated means with respect to a specific company any other company that, directly or indirectly, through one or more intermediaries is controlled, controlled or under common control by the specified company), shareholders, subsidiaries and/or controlling entities of IMCD ("Group Companies"); (ii) when third parties with whom IMCD has entered into business agreements provide you with information relating to you, and (iii) when the information comes from publicly available sources.
Obtaining information through the aforementioned sources helps us to improve the services we provide, as well as to comply with the primary and secondary purposes reported in this Privacy Notice.

4. Personal Data collected.
Depending on the relationship we generate with you (commercial, employment or contractual) we may collect the following identification and contact data: 
  • Full name.
  • Email.
  • Work, home and mobile phones. 
  • RFC. 
  • CURP. 
  • Complete address (proof of address). 
  • Country of residence. 
  • Date of birth.
  • Place of birth. 
  • Country of birth.
  • Nationality.
  • Activity, occupation or profession, as applicable.
  • Data containing your official identification (voter card, license, passport or immigration document), including photographs to verify the above.
  • Social security number.
  • Marital status.
  • Photography.
  • Level of education.
  • Opinion of compliance with tax obligations issued by the Tax Administration Service.
  • Opinion of compliance with obligations issued by the el Instituto Mexicano del Seguro Social.
  •  Opinion on compliance with obligations issued by the Instituto del Fondo Nacional de la Vivienda para los Trabajadores.
  • Images inside our offices.
  • Signature.

a) Personal Data of minors.
In general terms, we do not collect Personal Data from minors. 
The IMCD Websites are not intended for use by minors and we do not knowingly collect any personal data from such users. If we become aware that any underage user has provided personal data without the consent of their parent or guardian, we will delete such data immediately.

b) Sensitive personal, financial and patrimonial data.
Depending on the relationship we generate with you (commercial, employment or contractual) we may collect the following sensitive, financial and patrimonial data: 
  • Credit, business and/or personal references.
  • Transaction information related to the use of our services (payment method).
  • Bank statements.
  • Banking Institution and/or Associated Banks.
  • Account number.
  • Interbank CLABE account.
  • Branch.
  • Account holder.
  • Conjugal regime.
  • Gross monthly income.
  • Credit Bureau.
  • Information about your health status.
  • Geolocation.
  • Facts about your family.

We understand that the Personal Data of third parties that you provide to us (for example, personal and/or commercial references), already have or are exempt from authorization of their owner, to be delivered and processed by us in accordance with this Privacy Notice. 

In compliance with the provisions of Articles 9 and 16 of the Federal Law on the Protection of Personal Data in Possession of Private Parties ("LFPDPPP"), when we collect such data, we will ask for your express consent for its processing through any of the means permitted by applicable legislation.

5. Purposes of the processing of Personal Data.
a) Primary purposes:
  • Enable our provision of services (distribute and deliver supplies, devices, merchandise or products, operation of logistics models, warehouse management, inventories or other related services).
  • Comply with or generate contractual obligations.
  • Generate or fulfill labor relations.
  • Provide support, assistance, and customer service.
  • Verify identity.
  • Authorize lines of credit.
  • Receive or make payments.
  • Generate account statements.
  • Develop internal operations for the provision of our services and/or the delivery of supplies, devices, merchandise or products.
  • Carry out collection procedures.
  • Management and supply of goods and/or services.
  • For statistical purposes.

b) Secondary purposes:
  • Inform you of the launch or changes to our catalog of products, goods, or services.
  • To inform you about promotions and/or offers from IMCD in accordance with your interests, as well as from other Group Companies and/or business partners, including telephone calls, sending communications through emails and other physical and/or electronic means of communication.
  • Invite you to events, presentations, exhibitions or symposiums related to our industry and/or that of other Group Companies or business partners. 

If you do not want IMCD and/or the Group Companies to process your Personal Data for any of the purposes described in this section, please send an email to datospersonales@imcdmx.com. You can change your mind at any time.

It is important to note that if you provide your consent, it will remain valid even after the legal relationship between you and IMCD has ended, which means that IMCD may continue to process your Personal Data necessary to fulfill these secondary purposes.

6. Transfer of Personal Data.
Your Personal Data may be processed and transferred inside and outside the country, to authorities and Group Companies to comply with the purposes described in the preceding paragraph. 

7. Transfer of Personal Data not subject to consent.
IMCD may transfer your Personal Data to both domestic and foreign entities, without requiring your consent in the following cases: 
  • When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the owner, by the responsible party and a third party.
  • Competent authorities and third parties in the cases provided for by law.
  • Financial companies, credit information companies, surety companies and/or insurance companies for the fulfilment of obligations (when the business or contractual relationship justifies it).           
  • To the Group Companies so that they can contact you, directly or indirectly, to carry out promotional activities and/or offer products and/or services that these companies may market and/or provide jointly with IMCD or independently. We inform you that the group companies operate under privacy policies that comply with the corresponding applicable provisions. 

8. Links to Other Websites.
The IMCD Websites may contain links that allow you to easily visit other websites of interest. However, once you have used these links to leave our site, you should be aware that we do not have any control over these websites. Therefore, we cannot be responsible for the protection and privacy of any information you provide while visiting such websites and such websites are not governed by this Privacy Notice. 9. Means and procedure to exercise ARCO Rights and/or revocation of consent for the processing of Personal Data.
You or your legal representative may exercise any of the rights of access, rectification, cancellation or opposition (hereinafter "ARCO Rights"), as well as revoke your consent for the processing of your Personal Data by sending an email to the address datospersonales@imcdmx.com where you will be attended to in a timely manner.
Your petition must contain:
  • The name of the owner, email address and address or other means of communicating the response to your request.
  • Documents proving the identity or, where appropriate, the legal representation of the holder.
  • The clear and precise description of the Personal Data with respect to which you seek to exercise any of the aforementioned rights; and any other element or document that facilitates the location of the Personal Data.
  • In the case of rectification requests, the owner must indicate, in addition to the above, the modifications to be made and provide the documentation that supports their request.

The IMCD Personal Data Department will notify you of the decision adopted, within a maximum period of twenty (20) business days from the date on which the request was received, so that, if appropriate, it can be made effective within fifteen (15) business days following the communication of the response. The response will be sent electronically to the email address specified in your request.

10. Choices and Means to Limit the Use or Disclosure of Your Personal Data.
You may limit the use and disclosure of your personal information by contacting us, at the telephone numbers and emails indicated above, to determine whether we can accede to your request in terms of the LFPDPPP and its Regulations, by virtue of the commercial, contractual or employment relationship that you may have with IMCD and/or the Group Companies.

11. Security measures implemented.
We have implemented various security measures to prevent loss, misuse or alteration of your Personal Data. In the event that for any reason a security breach occurs with respect to the Personal Data we process, and that such violation significantly affects your economic or moral rights, we will contact you by email or telephone to inform you: i) the nature of the incident; ii) the personal data compromised; (iii) recommendations on measures you can take to protect your interests, and (iv) corrective actions taken immediately. 12. Modifications to the Privacy Notice.
IMCD reserves the right, in its sole discretion, to change, modify, add or remove in whole or in part this Privacy Notice at any time. In such event, IMCD will keep its Comprehensive Privacy Notice in effect on the www.imcdmx.com site. We recommend that you periodically check the date this document was last updated.

13. Use of cookies and web beacons.
Cookies are text files that are automatically downloaded and stored on the hard drive of the user's computer when browsing a specific Internet page, which allow the Internet server to remember some data about this user, including their preferences for viewing the pages on that server, date and time of access, Name and password. 
On the other hand, web beacons are images inserted into an Internet page or email, which can be used to monitor the behavior of a visitor, such as storing information about the user's IP address, duration of interaction time on that page and the type of browser used, among others. 

Through the use of cookies, we can collect the following data: your browser type and operating system, the Internet pages you visit, the links you follow, the IP address and the site you visited before entering ours.
Cookies and web beacons will allow us to tailor a web page or advertisement to your interests and preferences. In most Internet browsers you can delete cookies from your computer's hard drive, block them or receive a warning before a cookie is installed. 14. Right to promote Personal Data protection procedures.
If you consider that your right has been violated by any conduct of our employees or our actions or responses, you presume that in the processing of your personal data there is a violation of the provisions provided for in the LFPDPPP, its Regulations and other applicable regulations, you may file the corresponding complaint or complaint with the National Institute of Transparency. Access to Information and Protection of Personal Data ("INAI"), for more information visit its official website: https://home.inai.org.mx/.
